Astrofund Trader Agreement

Introduction

Welcome to Astrofund. This website is owned and operated by Astrofund LLC. By visiting our website and accessing the information, resources, services, products, and tools we provide, you agree to accept and adhere to the terms and conditions outlined in this Terms of Service (hereafter referred to as the “User Agreement”), along with our Privacy Policy (referenced below).

This agreement is effective as of December 9, 2024.

Astrofund reserves the right to modify this User Agreement at any time without prior notice. It is your responsibility to periodically review the User Agreement to stay informed of any changes. Your continued use of this website following changes constitutes acknowledgment and agreement to the modified terms.

Responsible Use and Conduct

By accessing Astrofund’s website and Resources, you agree to:

  • Use Resources only for lawful purposes and in compliance with this User Agreement.
  • Provide accurate and up-to-date registration information.
  • Maintain the confidentiality of login credentials and account information.
  • Refrain from unauthorized or unethical access to Resources, including automated or unconventional methods.
  • Refrain from disruptive activities that interfere with Astrofund’s operations or services.
  • Acknowledge full liability for any consequences of unauthorized activities, including criminal and civil penalties.

Astrofund reserves the right to suspend or terminate your access to its Resources for violations of this agreement, with or without notice, and to seek legal remedies for any damages incurred.

Customer Due Diligence (CDD) Policies & Procedures

Astrofund enforces strict Customer Due Diligence (CDD) policies to comply with legal and regulatory requirements. You agree to:

  • Provide accurate and verifiable information during registration.
  • Cooperate with Astrofund’s compliance procedures, including identity verification and transaction monitoring.

Failure to comply with CDD requirements may result in account suspension or termination without refund.

Anti-Money Laundering (AML) Policies & Procedures

Astrofund employs rigorous Anti-Money Laundering (AML) policies, including:

  • Monitoring and investigating transactions to detect suspicious activities.
  • Ongoing employee training and periodic policy audits to ensure compliance.
  • Reporting suspicious activities to relevant authorities as required by law.

By using Astrofund’s services, you agree to comply with all AML policies. Non-compliance may result in account suspension or termination and may be reported to authorities.

Privacy Policy

Astrofund respects your privacy and protects your personal information as outlined in our Privacy Policy. By using Astrofund’s services, you consent to the collection, use, and storage of your information for the purposes of account creation, transaction processing, and regulatory compliance.

No Refunds – All Sales Final

All purchases made through Astrofund are final. No refunds will be provided under any circumstances. By purchasing from Astrofund, you acknowledge and accept this policy.

Limitation of Warranty

Astrofund provides all Resources “as is” and “as available,” without any warranties, express or implied. Astrofund does not guarantee:

  • That Resources will meet your requirements.
  • Uninterrupted, secure, or error-free functionality of Resources.
  • Accuracy or reliability of any information obtained through Resources.

Limitation of Liability

Astrofund’s liability is limited to the amount paid for the specific product or service giving rise to the claim. Astrofund is not liable for:

  • Indirect, incidental, or consequential damages.
  • Loss of data, profits, or access due to service interruptions or errors.

Copyrights/Trademarks

All content, materials, and trademarks on Astrofund’s website are the intellectual property of Astrofund LLC and are protected by copyright and trademark laws. Unauthorized use is prohibited.

Termination of Use

Astrofund may terminate or suspend your access to its Resources at its sole discretion for violations of this agreement. Termination may occur without prior notice. Upon termination, you forfeit access to all associated accounts and Resources.

Responsible Trading Policy

Astrofund enforces strict trading guidelines:

  • Each user is permitted to register only one account with a single email address.
  • Users may maintain a maximum of 5 active accounts. Additional accounts may be queued for future activation at Astrofund’s discretion.
  • Adherence to trading rules is mandatory. Violations may result in account termination without refund.

Governing Law

This agreement is governed by the laws of the State of California. Any disputes or claims arising under this agreement must be resolved in the federal or state courts located in California. You consent to personal jurisdiction in California and waive objections to venue or inconvenient forum.

Class Action Waiver and Arbitration Agreement

By agreeing to this User Agreement, you waive the right to participate in or bring class action lawsuits against Astrofund. All disputes must be resolved individually through binding arbitration in California.

Dispute Resolution

By using Astrofund’s services, you waive the right to dispute payments. Astrofund reserves the right to enforce this waiver through your financial institution or other legal means.

Guarantee

Astrofund disclaims all warranties unless explicitly stated otherwise.

RISK DISCLOSURE: This is not an investment opportunity. You do not deposit any funds for investment. We do not ask for any funds for investment. At no time do you risk your own capital. There are no promises of rewards or returns.

HYPOTHETICAL PERFORMANCE DISCLOSURE: Hypothetical performance results have many inherent limitations, some of which are described below. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown. In fact, there are frequently sharp differences between hypothetical performance results and the actual results subsequently achieved by any particular trading program. One of the limitations of hypothetical performance results is that they are generally prepared with the benefit of hindsight. In addition, hypothetical trading does not involve financial risk, and no hypothetical trading record can completely account for the impact of financial risk of actual trading. For example, the ability to withstand losses or to adhere to a particular trading program in spite of trading losses is material points, which can also adversely affect actual trading results. There are numerous other factors related to the markets in general or to the implementation of any specific trading program, which cannot be fully accounted for in the preparation of hypothetical performance results and all of which can adversely affect trading results. AVAILABLE INSTRUMENTS: Astrofund customers are allowed to only trade Futures products, listed on the following exchanges: CME, COMEX, NYMEX & CBOT. Trading of Spot Currencies, CFD’s Stocks, Options, and Cryptocurrencies are not permitted or available in our programs vendors or platforms.

EVALUATION DISCLAIMER: The Evaluation and Funded account phases are meant to be as close to a realistic simulation of trading under actual market conditions, including commissions, to mimic real market conditions, and the evaluation is difficult to pass even for experienced traders. The event is not meant to train the customer to be better but to be a challenge to pass. The Evaluation is not suggested for individuals with little to no trading experience.

CFTC Rule 4.41: Hypothetical or Simulated performance results have certain limitations. Unlike an actual performance record, simulated results do not represent actual trading. Also, because the trades have not actually been executed, the results may have under-or-over compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated trading programs, in general, are also subject to the fact that they are designed with the benefit of hindsight.
